Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the use of services provided by MILKATE s.r.o., Company ID: 07738137, with its registered office at Doksany 154, 411 82, registered in the Commercial Register maintained by the Regional Court in Ústí nad Labem, Czech Republic ("Provider", "we", "us"). We are VAT registered.

By ordering or using our services, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, you should not use our services.

2. Scope of Services

We provide digital services including but not limited to:

Redrawing technical, architectural, or other drawings from physical or image format into digital formats (e.g., DWG, PDF)
Other related services as may be agreed in writing between the parties

3. Orders and Communication

Orders can be placed via our online form, by email, or through another agreed method.

You must provide all necessary materials (e.g., photographs, scans of drawings, specifications) in a clear and usable quality. You are solely responsible for the accuracy, completeness, and legality of the provided materials.

4. Prices and Payment Terms

The price for the service will be quoted individually based on the scope and complexity of the work.

Payment must be made:

in advance (for smaller projects), or
after acceptance of our quotation and issuance of a proforma invoice.

Invoices are issued electronically. All prices are exclusive of VAT unless stated otherwise.

5. Delivery Times

The delivery time will be confirmed when the order is accepted.
It may vary depending on the project scope and our workload.

We are not liable for delays caused by incomplete, incorrect, or late delivery of materials by you.

6. Rights of Use

Upon full payment, you receive a non-exclusive, non-transferable right to use the delivered outputs (digital drawings, models) for your own internal business or personal purposes.
You may not sell, sublicense, or distribute them to third parties without our prior written consent.

We reserve the right to use anonymized examples of the work as references, unless expressly prohibited by you in writing.

7. Complaints and Corrections

You must notify us of any defects in the delivered outputs within 7 days of delivery. The notification must include a detailed description of the defect.

If the complaint is justified, we will make corrections at no additional cost within a reasonable timeframe.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business opportunities, arising from the use or inability to use our services.

We are not responsible for errors resulting from inaccurate or incomplete materials provided by you.

9. Personal Data Protection

We process all personal data in compliance with applicable laws, including the General Data Protection Regulation (GDPR).

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.

11. Final Provisions

We may update these Terms from time to time. Any changes will be posted on our website and will take effect upon posting.
By continuing to use our services after changes are posted, you agree to be bound by the updated Terms.
